Please take the time to read and understand the conditions of booking set out below prior to booking a trip with us.
By booking a trip with us you are deemed to have agreed to these Booking Conditions (which constitutes the entire agreement between you and us, and your booking will be accepted by us on this basis). The services to be provided are those referred to in your booking confirmation invoice.
The Eco & Spiritual Explorer Services are available only to legal entities and individuals in business who can form legally binding contracts. To use the Eco & Spiritual Explorer Services available from the Site (www.eco-explorer.com), you must register for a Eco & Spiritual Explorer account (“Account”). In order for us to confirm your travel arrangements you must provide all requested details with the balance of the trip price. Necessary details vary by trip; they include but are not limited to full name as per passport, date of birth, nationality, passport number, passport issue and expiry date and any pre-existing medical conditions you have which may affect your ability to complete your travel arrangements. You are required to update such information to maintain its truth, accuracy and completeness. Misleading information about your location is not allowed. Failure to provide requested details may result in additional charges or non-refundable cancellation of your trip.
The Eco & Spiritual Explorer S.R.L. is society headquartered in San Jose CR, with the single registration and legal person, Register No. 3-102-745542. This agreement shall be governed by the laws of the seat of the operator.
Acceptance of booking and final payments
A contract is made between you and The Eco & Spiritual Explorer only upon your booking being confirmed and accepted by us.
In order to reserve your holiday, a payment of 30% of price must be submitted to the Eco & Spiritual Explorer by you.
On receipt of your payment ( subject to availability and at our discretion) The Eco & Spiritual Explorer will reserve your place on your selected holiday. The payment is accepted as a first instalment of the holiday price or full payment by The Eco & Spiritual Explorer only once the booking has been confirmed in writing by The Eco Explorer.
Payment of the balance of the price is due 60 days before the scheduled holiday departure date which shall be by the due date stated on the confirmation issued to you by The Eco Explorer.
If payment isn’t made by the due date, The Eco & Spiritual Explorer may assume that you have cancelled and cancellation charges will be levied by The Eco Explorer.
Any travel documents will not be forwarded until full payment has been received by us.
In the case of Late Bookings made within 59 days of your departure, the full cost of the holiday will be payable immediately on booking and we reserve the right to provide all travel documents at the holiday departure point.
The Eco & Spiritual Explorer reserves the right to cancel the booking and apply cancellation charges should payments not be received within the above specified periods.
Prices & surcharges
Those in the program prices are based on costs of services and exchange rates prevailing at the date of programming and may therefore be subject to change. Our trip prices are subject to variable and seasonal pricing, both of which are standard practice within the travel industry. This means our trip prices may vary at any time in accordance with demand, market conditions and availability. It is likely that different passengers on the same trip have been charged different prices. Your best option if you like the price you see is to book at that time. Once you have received a quote the price will be locked in providing you to pay the required deposit prior to the quote’s expiry. Any reduced pricing or discounts that may become available after you have paid your deposit will not apply. If you wish to cancel your booking to take advantage of a cheaper price, full cancellation conditions apply. The most up to date pricing is available on our website. Prices are based on currency exchange rates as of December 2017; note that prices may vary depending on which currency the booking is made. We reserve the right to impose surcharges up to 59 days before departure due to unfavorable changes in exchange rates, increases in airfares or other transportation costs, increases in local operator costs, taxes, or if government action should require us to do so. In such instances we will be responsible for any amount up to 2% of the trip price and you will be responsible for the balance. If any surcharge results in an increase of more than 10% of the trip price you may cancel the booking within 14 days of notification of the surcharge and obtain a full refund. We will not surcharge any booking for travel within the validity of this brochure once paid in full. Please note that a surcharge may be applied to all purchases made by credit card.
If you change your booking
If after your booking has been confirmed, you wish to change to an alternate departure date you may do so subject to availability and provided the new holiday date is also in this website.
A fee of USD30 per person will be charged for any revision or alteration made to a reservation after the booking is confirmed, unless the change increases the value of the booking. A change of booking within 45 days of departure will be treated as a cancellation and normal cancellation fees will apply (as detailed above) except when the change is to an earlier departure date of equivalent or greater value, in which case a USD30 per person amendment fee will be charged.
A name change to a different person will be treated as a cancellation.
Cancellation by us
If the booking is cancelled before departure for any reason other than non-payment by you then you will be offered the choice of purchasing another arrangement from The Eco & Spiritual Explorer, with the price difference payable/refundable as appropriate, or of receiving a full refund of all monies paid to The Eco & Spiritual Explorer (except insurance premium and any amendment fees), unless the cancellation has been caused by “force majeure” or “low bookings” (defined below). The Eco & Spiritual Explorer will never cancel a package within 30 days of departure except for reasons of “force majeure”. In circumstances where the cancellation is due to external events outside our reasonable control refunds will be less any unrecoverable costs. We are not responsible for any incidental expenses that you may have incurred as a result of your booking including but not limited to visas, vaccinations, travel insurance excess or non-refundable flights.
Force Majeure/Low Bookings
(a) “Force Majeure”: includes war, threat of war, riot, civil disobedience or strife, industrial dispute, terrorist activity, natural or industrial disaster, fire, adverse weather conditions, level of water in rivers, technical or maintenance problems with transfer, unforeseen operational decisions of air carriers such as changes of schedule, or any unforeseeable or unavoidable event beyond the Company’s control.
(b) “Low Bookings”: is where the number of persons who have booked a particular arrangement is less than the minimum required to make it viable.
If you cancel
If you cancel some or all portions of your booking cancellation fees will apply. A cancellation will only be effective when we receive written confirmation of the cancellation and will apply cancellation charges as shown below. These charges are based on period of notice and are a percentage of the total cost of your booking.
Period of notice up to 60 days – Cancelation Fee is 30%
Period of notice between 60 to 0 days – Cancelation Fee is 100%
If you leave a trip for any reason after it has commenced we are not obliged to make any refunds for unused services. If you fail to join a tour, join it after departure, or leave it prior to its completion, no refund will be made. If the reason for cancellation falls within the terms of any holiday insurance policy which you hold, then any such charges may, subject to the terms of your insurance policy, be refunded to you by the insurance company.
Small groups & combination trips
Our trips are guaranteed to depart once they have one fully paid traveller unless minimum group size specifically states otherwise. This means at times we can have groups with small numbers of travellers. Many of our trips are designed to fit with other departures to create a longer “combination” trip; this means that some of your group may have already been travelling together for some weeks when you commence your trip. If you would like to know how many people are booked on your trip or any combination trip it is part of please ask prior to making your booking.
Passport & Visas
It is your own responsibility to ensure that are in possession of a full passport with at least 6 months validity from date of your return. You will also need to make sure that you have sufficient blank pages for any visa stamps. We are not responsible if you are refused entry to a country because you lack the correct passport, visa or other travel documentation.
You must undertake a travel insurance, it is mandatory for all our travelers. Your travel insurance must provide cover against personal accident, death, medical expenses and emergency repatriation with a recommended minimum coverage of US$100,000 for each of the categories of cover. We also strongly recommend it covers cancellation, curtailment, personal liability and loss of luggage and personal effects. You must provide proof of your travel insurance on the first day of your trip; you will not be able to join the trip without it. Not subscribing travel insurance or inadequate purchasing a travel insurance, you will be automatically exempt all its service providers partners from any and all liability relating to the risks and consequent costs that you incur by not having carried out the protection that was recommended to you.
Holiday details and conditions
Please read the program carefully for those items included in the price. No allowance or refund can be made for meals, accommodation, excursions, etc. that you elect not to take, or when museums, shops, etc are closed. Hotel facilities may vary from place to place. Meals may vary in style.
The Eco & Spiritual Explorer strives to provide a safe, enjoyable and memorable travel experience for all travellers. The Eco & Spiritual Explorer welcomes tarvellers with special needs or disabilities. However, please note the following:
Travellers are required to advise The Eco & Spiritual Explorer , in advance, of any physical, medical or other special needs that require accommodation.
All travellers must ensure they are medically and physically fit for travel. The Eco & Spiritual Explorer may impose safety requirements necessary for the safe operation of the tour. The Eco & Spiritual Explorer may also exclude an individual from participating in a tour or an activity if that individual’s participation poses a direct threat to health or safety.
The Eco & Spiritual Explorer does not provide personal devices (such as wheelchairs, hearing aids or prescription eye glasses) or services of a personal nature (such as pushing a wheelchair or assistance in eating, assisting with luggage, toileting or dressing,). A companion capable of providing such assistance must accompany any traveller who requires services of a personal nature.
The Eco & Spiritual Explorer does not employ medical personnel. Any necessary medical attention will be provided by a local facility at the traveller’s expense. The Eco & Spiritual Explorer is not responsible or liable for any losses or costs incurred as a result of medical services obtained while on tour, or for the quality of the care or services received.
Travellers should be aware some tours include rough terrain, extensive walking over cobblestone streets, uneven pavement, steps and locations & overnight accommodations which may not be easily accessible or accessible by wheelchair. During the tour, The Eco & Spiritual Explorer may make arrangements with carriers, hotels and other independent suppliers to provide travel services. These parties are independent entities over which The Eco & Spiritual Explorer has no control. The Eco & Spiritual Explorer cannot guarantee disability access or accommodations for travellers traveling on international tours.
Travellers are required to carry their own luggage to the transports and also to their rooms, there may be times travellers are required to carry their luggage far distances & up many flights of stairs with no assistance.
The Eco & Spiritual Explorer may, in its sole discretion, decline the booking of any traveller or remove any traveller who cannot comply or refuses to comply with The Eco & Spiritual Explorer ’s terms and conditions. The Eco & Spiritual Explorer is not responsible for any costs incurred in the event a traveller is removed from a tour. Travellers agree not to hold The Eco & Spiritual Explorer or any of its related entities liable for any actions taken under these terms and conditions.
There may be times when the The Eco & Spiritual Explorer leader has to make a decision in your best interests or the best interests of their group. You agree to comply with the authority and decisions of the appointed The Eco & Spiritual Explorer leader and the laws of the country in which you are travelling. If you do not so comply or if, in the The Eco & Spiritual Explorer leader’s opinion, you are not compatible with the general enjoyment and well being of other members on the holiday or smooth operation of the holiday itself, we reserve the right to refuse to let you continue with the holiday. We do not tolerate the possession or carriage of illegal or restricted substances (drugs). Furthermore, you agree that your fellow travellers and any The Eco & Spiritual Explorer leader have the right to travel/work in a safe environment. Any threats to their safety, well being or inappropriate behaviour by you, whether verbal or physical, will be taken extremely seriously and may result in the immediate termination of your holiday. In such event, you will be responsible for your own repatriation and related costs and have no claims against us.
You are responsible for any costs incurred as a result of damage or excess cleaning fees related to your accommodation. You are advised to immediately report any pre-existing damage in your room to hotel staff and/or a The Eco & Spiritual Explorer leader as soon as it is discovered.
The Eco & Spiritual Explorer may, in its sole discretion, decline the booking of any traveller or remove any traveller who cannot comply or refuses to comply with the The Eco Explorer’s terms and conditions. The Eco & Spiritual Explorer is not responsible for any costs incurred in the event a traveller is removed from a tour. Travellers agree not to hold the The Eco & Spiritual Explorer or any of its related entities liable for any actions taken under these terms and conditions.
Where the traveller occupies a motorcoach seat fitted with a safety belt, neither the operator or service providers, agents or cooperating organisations shall be liable for any illness, injury or death nor any loss, damages or claims whatsoever arising from any accident or incident, if the safety belt is not being worn at the time of the accident or incident.
It is your responsibility to have a valid passport (minimum of 6 months after you return) and all visas, permits and certificates required for your selected holiday as well as any necessary vaccinations and to comply with all applicable laws.
You agree that our The Eco & Spiritual Explorer leader may take photographs and films of you while you are on holiday and that these may be used in our brochures and/or advertising or publicity material without obtaining any further consent or payment in respect of such photographs and/or films.
Should you have a complaint in respect of the holiday, you should inform the The Eco & Spiritual Explorer leader during the course of the holiday and if the matter cannot be resolved after the leader’s best endeavours to do so during the holiday, your complaint should be made in writing to The Eco & Spiritual Explorer as soon as is reasonably possible after the holiday, but within 15 days thereof so that your complaint can be investigated. If you do not write within 15 days, your rights under this contract may be affected. If you choose to write to The Eco & Spiritual Explorer via the Internet, please provide your home address so that we are able to reply to you in writing.

Kitty as specified in the Essential Trip Information
Airport transfers, taxes and excess baggage charges unless specified
Meals other than those specified in the Essential Trip Information
Visa and passport fees
Optional activities and all personal expenses
Under no circumstances can we be held responsible for weather conditions, nor can any holiday be cancelled or amended by you at any time on the basis of weather conditions.
On tours it is your responsibility to make sure your luggage doesn’t exceed the weight restrictions imposed by transportation suppliers.
By using the Services, you consent to receiving electronic communications from Eco & Spiritual Explorer. These electronic communications may include notices about applicable fees and charges, transactional information and other information concerning or related to the Eco & Spiritual Explorer Services. These electronic communications are part of your relationship with Eco & Spiritual Explorer and you receive them as part of your subscription to the Eco & Spiritual Explorer Services. You agree that any notices, agreements, disclosures or other communications that we send you electronically will satisfy any legal communication requirements, including that such communications be in writing.
